Terms and Conditions Of Booking


Applies to Orbiy 'Rent' (Self-Drive Hire) and Orbiy 'Ride' (Chauffeur Services)

1. Introduction

These Terms of Booking (“Terms”) form a legally binding agreement between you (“the Customer”, “you”) and Orbiy Limited (“Orbiy”, “we”, “us”, “our”) regarding the use of our services:

  • Orbiy Rent – self-drive vehicle hire

  • Orbiy Ride – chauffeur-driven transport

By making a booking, you confirm that you have read, understood and agree to be bound by these Terms.


2. Booking & Payment

2.1 Booking Confirmation

A booking is confirmed only when:

  • You provide all the required information,

  • Orbiy verifies your eligibility,

  • the required payment or deposit is received, and

  • Orbiy issues a written booking confirmation.

We reserve the right to refuse a booking at our sole discretion if eligibility, verification, or risk assessments are not met.


2.2 Payments

You authorise Orbiy and its payment partners to:

  • charge your card for booking fees, deposits and adjustments;

  • collect additional charges lawfully incurred under these Terms;

  • process refunds where applicable.

All payments are handled through PCI-compliant processors such as Stripe or Windcave.


2.3 Deposits

Deposits may include:

  • reservation deposits,

  • security deposits,

  • preauthorisations.

Deposits may be used to cover:

  • damage,

  • cleaning costs,

  • late returns,

  • PCNs and traffic charges,

  • tolls and ULEZ/Congestion charges,

  • excessive mileage,

  • any breach of these Terms.

Unused amounts will be refunded in accordance with the banking and card issuer's timeframes.


3. Orbiy Rent (Self-Drive Hire)

3.1 Eligibility to Rent

To hire a vehicle through Orbiy Rent, you must meet the following minimum criteria:

  • You must be at least 30 years old.

  • Customers aged 25–29 may be accepted only upon manual approval, following enhanced verification checks. Additional charges, increased excesses or insurance restrictions may apply.

  • You must hold a valid UK or EU full driving licence that has been held for at least 3 years.

  • Your licence must contain no penalty points or endorsements.

  • Drivers who do not meet these criteria may be considered on a discretionary, case-by-case basis, but may be subject to higher fees, increased excesses, additional verification or rejection.

  • You must pass Orbiy’s identity, fraud, eligibility and insurance validation checks.

Orbiy may refuse a rental application where insurance or risk-related requirements are not met.


3.2 Vehicle Use

You agree to:

  • operate the vehicle responsibly and legally;

  • ensure only authorised drivers drive the vehicle;

  • not use the vehicle for courier work, racing, off-road use or illegal activity;

  • not smoke or vape inside the vehicle;

  • Take reasonable care to prevent theft, damage or misuse.


3.3 Vehicle Condition & Return

You must:

  • Inspect the vehicle before driving and report pre-existing damage;

  • return the vehicle at the agreed time and location;

  • return the vehicle in the same condition (fair wear and tear accepted);

  • return with the agreed fuel/charge level;

  • Ensure no personal belongings are left inside.

Late returns may incur additional daily charges or penalties.


3.4 Fines, Penalties & Charges

You are responsible for:

  • parking fines,

  • speeding fines,

  • PCNs,

  • ULEZ and Congestion charges,

  • toll road fees,

  • any other penalties incurred during the hire period.

Orbiy may charge the payment method on file for associated fees, administrative time and penalties.


3.5 Damage, Loss & Insurance

Orbiy vehicles are insured; however:

  • insurance excess applies to damage or loss,

  • excess may vary depending on driver age or risk category,

  • negligence, improper use or breach of Terms may invalidate cover,

  • Telematics data may be used to investigate incidents, behaviour or claims.

Orbiy may, where necessary, charge the card on file to recover costs relating to damage or loss.


4. Orbiy Ride (Chauffeur Services)

4.1 Customer Responsibilities

You must:

  • provide accurate pick-up and drop-off information,

  • be ready at the agreed time,

  • treat the driver and vehicle with respect,

  • not smoke or vape in the vehicle,

  • comply with safety and seatbelt requirements.


4.2 Waiting Time, Delays & Cancellations

Waiting time, late changes, or cancellations may incur additional charges, as displayed at the time of booking or communicated to you.

Orbiy is not liable for delays caused by traffic, weather or events beyond our control.


4.3 Children & Safeguarding (Ride)

Children may travel with Orbiy Ride, including unaccompanied minors, only where a parent or legal guardian explicitly authorises the journey.

Orbiy drivers must:

  • follow safeguarding principles,

  • avoid unnecessary physical contact,

  • Release the child only to the authorised receiving adult,

  • follow exactly the pick-up and drop-off instructions provided,

  • not record or photograph minors.

Parents/guardians are responsible for providing suitable child seats unless otherwise agreed.


5. Cancellations & Refunds

5.1 Customer Cancellations

Your refund eligibility depends on the cancellation terms presented during booking.
Late cancellations may result in partial or full charge retention.


5.2 Orbiy Cancellations

Orbiy may cancel a booking where:

  • verification or eligibility checks fail,

  • payment cannot be authorised,

  • Fraud is suspected,

  • a vehicle or driver becomes unavailable,

  • a safety or compliance issue arises.

Refunds will be processed where appropriate.


6. Your Obligations

You must:

  • provide accurate and truthful information,

  • comply with all laws,

  • follow instructions from Orbiy staff or drivers,

  • treat vehicles and personnel with respect.

Orbiy may refuse service or cancel bookings where behaviour is unsafe, abusive, fraudulent or non-compliant.


7. Orbiy’s Obligations

Orbiy will:

  • provide services with reasonable skill and care,

  • ensure vehicles are maintained, insured and roadworthy,

  • ensure drivers are appropriately trained and vetted,

  • Respond to issues or complaints promptly.


8. Liability

8.1 What Orbiy Is Responsible For

We are liable for:

  • foreseeable loss caused by our failure to exercise reasonable care,

  • damage caused by our negligence.

8.2 What Orbiy Is Not Responsible For

We are not liable for:

  • indirect or consequential loss,

  • loss of personal items left in vehicles,

  • delays caused by traffic, breakdowns or events outside our control,

  • third-party actions.

Nothing in these Terms excludes:

  • liability for death or personal injury caused by negligence,

  • liability for fraud,

  • rights you have under the Consumer Rights Act 2015.


9. Telematics & Monitoring

Orbiy vehicles may record:

  • GPS location,

  • speed and braking patterns,

  • ignition activity,

  • route and trip data,

  • vehicle diagnostics.

Telematics data is used for:

  • safety,

  • insurance compliance,

  • fraud prevention,

  • incident verification,

  • service optimisation.

Processing is carried out in accordance with the Privacy Policy.


10. Data Protection

All personal data is processed in accordance with our Privacy Policy, available on our website.


11. Amendments

Orbiy may amend these Terms from time to time.
Updated Terms apply to future bookings upon publication.
